Liability Limitations: Our services are provided strictly on an "as is" basis. SinappGames expressly disclaims liability for indirect damages, data loss, or service interruptions. Dispute Resolution: Disputes shall be resolved primarily through informal negotiation, followed by binding arbitration where legally permissible, waiving the right to class action lawsuits. This Terms of Service agreement (hereinafter referred to as the "Agreement") constitutes a legally binding contract between you (the "User") and SinappGames regarding your access to and use of our Android mobile applications, games, and related digital services. By downloading, installing, accessing, or otherwise utilizing any software provided by SinappGames, you hereby expressly acknowledge that you have read, understood, and agree to be bound by the stipulations contained herein. If you do not agree to these terms in their entirety, you shall immediately cease all use of our services and uninstall our applications from your devices. Our services incorporate gameplay mechanics, digital content, third-party advertisements, and opportunities for In-App Purchases. Eligibility and Age Requirements Access to our services is strictly contingent upon your compliance with applicable age restrictions. You must be at least thirteen (13) years of age to access our games. Furthermore, if you are between the ages of thirteen (13) and the age of majority in your jurisdiction of residence, you hereby represent and warrant that your legal guardian has reviewed and consented to this Agreement on your behalf. Users must be at least eighteen (18) years of age, or possess explicit legal guardian consent, to execute any In-App Purchases. Service Availability Notwithstanding our efforts to maintain consistent service, SinappGames does not warrant that the applications shall be uninterrupted, error-free, or perpetually available. We reserve the right to modify, suspend, or discontinue any portion of the services, including specific game features or server access, at our sole discretion and without prior notice. To ensure optimal performance, users shall be responsible for maintaining compatible hardware and updated operating systems. 3. YOUR ACCOUNT Registration and Authentication While SinappGames may not require a proprietary standalone account, your access to our services and preservation of gameplay data is intrinsically linked to your Google Play account and Google Play Games profile. You hereby agree that the terms governing your Google account shall concurrently apply to your authentication within our applications. Security Obligations You shall bear sole responsibility for maintaining the confidentiality and security of your device and associated account credentials. SinappGames shall not be held liable for any loss, damage, or unauthorized In-App Purchases arising from your failure to secure your device or account. Account Accuracy and Transferability You are required to provide accurate and current information when interacting with our services. Furthermore, you hereby acknowledge that your account, including all associated progression and virtual items, is strictly non-transferable. You shall not sell, rent, lease, or otherwise transfer your account access to any third party. Should you wish to terminate your relationship with SinappGames, you may do so by uninstalling our applications and deleting your associated local and cloud save data. 4. ACCEPTABLE USE Permitted Conduct SinappGames grants you access to our applications strictly for personal, non-commercial entertainment purposes. You shall utilize the services only in a manner that complies with all applicable local, state, national, and international laws and regulations. Prohibited Activities To protect the integrity of our software and the experience of our user base, you hereby agree that you shall not engage in any of the following prohibited activities: Reverse Engineering: You shall not decompile, disassemble, reverse engineer, or attempt to derive the source code of our Android applications. Cheating and Exploitation: You shall not utilize, develop, or distribute automated software programs, "bots," "cheats," "hacks," or any unauthorized third-party software designed to modify or interfere with the intended gameplay experience.Third-party services operate under their own privacy policies. Commercial Exploitation: You shall not exploit the games, or any portion thereof, for commercial purposes, including but not limited to gathering virtual currency for real-world sale. Interference: You shall not disrupt, overburden, or aid in the disruption of any computer or server utilized to offer or support our services. Ad Manipulation: You shall not employ mechanisms to artificially inflate ad impressions, block advertisements, or otherwise interfere with the third-party ad networks integrated into our games. Enforcement and Reporting Violation of these acceptable use provisions shall constitute a material breach of this Agreement. SinappGames reserves the right to immediately suspend or terminate your access to the services without prior notice or liability. Users are encouraged to report any suspected violations of this policy directly to our support team. 5. CONTENT & INTELLECTUAL PROPERTY Ownership of Services SinappGames retains all right, title, and interest in and to the applications, including but not limited to all software code, visual interfaces, graphics, design, compilation, information, data, audio files, and all other elements of the games. These assets are protected by international copyright, trademark, and intellectual property laws. License Grant to User Subject to your strict compliance with this Agreement, SinappGames hereby grants you a personal, limited, revocable, non-exclusive, non-transferable license to download, install, and execute our applications on compatible Android devices solely for your personal, non-commercial entertainment. User-Generated Content To the extent that our applications permit you to create, submit, or display content (such as usernames or custom avatars), you hereby grant SinappGames a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to use, reproduce, modify, adapt, publish, and display such content in connection with the operation and promotion of the services. If you believe that any content within our applications infringes upon your intellectual property rights, you shall submit a formal takedown notice to our contact email provided herein. 6. PAYMENTS & BILLING In-App Purchases and Virtual Goods Our applications may include opportunities to acquire virtual currency, digital items, or premium features (collectively, "In-App Purchases"). You hereby acknowledge that such In-App Purchases do not constitute the purchase of physical goods. Instead, you are purchasing a limited, personal, revocable, non-transferable license to utilize specific digital features within the game. Virtual goods and currency hold no real-world monetary value and cannot be exchanged for legal tender. Billing Processing All financial transactions are processed exclusively through the Google Play Store billing system. SinappGames does not directly collect, process, or store your credit card information. Consequently, your purchases are subject to the terms, conditions, and payment policies established by Google Play. Refund Policy Notwithstanding any applicable consumer protection laws in your jurisdiction, all In-App Purchases are deemed final and non-refundable upon delivery of the digital content. SinappGames shall not issue refunds for accidental purchases, buyer's remorse, or account termination. Any requests for refunds must be directed to Google Play support, which shall adjudicate such requests in accordance with their proprietary refund policies. Pricing Modifications SinappGames reserves the right to modify the pricing, availability, and specifications of any In-App Purchases at our sole discretion, without prior notice. DISCLAIMERS & LIMITATIONS Disclaimer of Warranties THE SERVICES PROVIDED BY SINAPPGAMES ARE DELIVERED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SINAPPGAMES EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAMES SHALL BE UNINTERRUPTED, BUG-FREE, OR SECURE FROM MALICIOUS INTRUSION. Limitation of Liability NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, IN NO EVENT SHALL SINAPPGAMES, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA ARISING FROM YOUR USE OF THE SERVICES. Liability Cap TO THE EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, SHALL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO SINAPPGAMES FOR IN-APP PURCHASES DURING THE SIX (6) MONTHS STRICTLY PRECEDING THE CAUSE OF ACTION. Certain jurisdictions do not allow the exclusion or limitation of certain damages; thus, some of the above limitations may not apply to you in your capacity as a consumer. 9. DISPUTE RESOLUTION Informal Resolution In the event of any controversy, claim, or dispute arising out of or relating to this Agreement, the parties shall first attempt to resolve the matter informally. You shall provide written notice of the dispute to SinappGames via email, and the parties shall negotiate in good faith for a period of no less than thirty (30) days. Exceptions Notwithstanding the foregoing, either party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights. 10. CHANGES & TERMINATION Modification of Terms SinappGames reserves the right, at its sole and absolute discretion, to amend, modify, or replace this Agreement at any time. In the event of a material change, we shall provide notice by updating the "Effective Date" at the top of this document and, where appropriate, providing an in-app notification. Your continued use of the services following the posting of any changes constitutes your formal acceptance of the revised Agreement. Termination by SinappGames We reserve the right to terminate your license to use our applications and block future access to our services, without notice and at our sole discretion, if we determine that you have breached any provision of this Agreement. Upon termination, all rights and licenses granted to you herein shall immediately cease. Users are advised to review this Agreement periodically to ensure continued compliance with our operational policies. 11. GENERAL LEGAL Governing Law This Agreement shall be governed by and construed in accordance with applicable international commercial laws, without regard to conflict of law principles. Where mandatory consumer protection laws of your jurisdiction of residence apply, those laws shall take precedence to the extent required. Severability If any provision of this Agreement shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable. Entire Agreement This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and SinappGames regarding the use of our services, superseding any prior agreements, communications, or understandings, whether written or oral. Assignment You may not assign, delegate, or transfer these terms or your rights or obligations hereunder without the prior written consent of SinappGames. SinappGames may assign its rights and obligations under this Agreement without restriction. 12.
